Termination of alimony for the adult daughter upon completion of her professional training
The Superior Court of Justice of Aragon has resolved an interesting case regarding the alimony that a father had been paying to his daughter, who is already an adult. The key point of this conflict is that the daughter completed higher education studies (a professional training that allows her easy access to the job market), obtained a job with a full-time permanent contract and had her own income. However, after working for a while, the daughter decided to voluntarily quit her job to resume her studies by starting a university degree. The father requested the court to terminate
his obligation to continue paying the alimony, as he believed that his daughter, having completed sufficient training and having demonstrated that she could work and support herself, no longer had the right to continue receiving this support. The court of first instance agreed with the father and terminated the alimony, but the Provincial Court overturned this decision and stated that the alimony had to be maintained, because the daughter, upon returning to study, needed financial assistance and was not yet independent. Faced with this situation, the case reached the Superior Court of Justice of Aragon, which ultimately sided with the father. The court makes it clear that, once an
adult child has completed their professional training and has had a job under suitable conditions, the parents' obligation to pay alimony is only exceptional. That is, it is customary for the payments to cease, unless the child has not completed their training or, for other reasons, still needs financial assistance. In this case, the daughter had already shown that she could support herself, so the court confirms that the alimony must be terminated.
